It is Ordered that the motion to vacate the stay is denied as academic. The September 23, 2008 order of this court only continued the stay until October 8, 2008, in order for the appellants to tender use and occupancy to the petitioner and thereafter, move for a continuation of the stay. No stay was granted beyond October 8, 2008.
