Motion by the appellant for leave to reargue its motion to stay enforcement of an order of the Supreme Court, Queens County, entered August 21, 2008, as well as all proceedings in the above-entitled action, pending hearing and determination of an appeal from the order, which was determined by decision and order on motion dated September 24, 2008.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
