Motion by the court-appointed inventory attorney, Catherine S. Sammartino, for an order relieving her of her inventory assignment, directing that the unclaimed files be destroyed, stored, or retained by the state; designating the manner in which such unclaimed files are to be destroyed, stored, or retained; and designating the party or parties to oversee the destruction, storage, or retention of those files.
By decision and order on motion of this court dated July 18, 2006, the respondent was suspended on the ground of medical incapacity pursuant to 22 NYCRR 691.13(b)(1), for an indefinite period of time and until further notice of this court, based upon the reports of the respondent's treating doctors dated April 3, 2005, and March 22, 2006, and Catherine S. Sammartino was appointed, pursuant to 22 NYCRR 691.13(d), to inventory the respondent's files and take such action as was deemed advisable to protect the interest of the respondent's clients and those of respondent as well. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 14, 1987, under the name Alan Mark Rocoff.
Upon the papers submitted in support of the motion, it is
ORDERED that the motion is granted to the extent that Catherine S. Sammartino is hereby discharged of her duties to inventory the respondent's files, and she is authorized to dispose of unclaimed files as appropriate under the guidance of the Office of Special Counsel, Robert P. Guido, and the motion is otherwise denied.
