Ackerman, Albert, M.D., et al. v Wales, Elliot, et al.
It is Ordered that the motion is granted only to the extent of directing the appellant to submit supplemental records on appeal that contain a complete set of the motion papers listed in the August 1, 2006 Civil Court order and the plaintiff's memo of law in support of its motion for a directed verdict. The appellant's time to perfect this appeal is extended to the February 2009 term - the filing deadline is December 9, 2008. The records previously submitted to this Court are incomplete and will only be placed on the calendar after the supplemental records are filed. The motion for sanctions is denied.
