DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue its prior motion for leave to prosecute an appeal from an order of the Supreme Court, Nassau County, entered December 7, 2007, as a poor person, including to waive all filing fees and to proceed on the original papers, which was determined by decision and order on motion dated September 3, 2008, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition or thereto, it is

ORDERED that the branch of the motion which is for leave to reargue is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until December 1, 2008, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted.
