| DECISION & ORDER ON APPLICATION |
Application by the appellants on appeals from an order of the Supreme Court, Orange County, dated January 24, 2008, and a judgment of the same court dated May 28, 2008, to substitute Marcy Rappaport, administrator of the estate of Lawrence Rappaport, for the deceased defendant Lawrence Rappaport.
Upon the papers filed in support of the application and upon the stipulation of the parties, it is
ORDERED that the application is granted and Marcy Rappaport, administrator of the estate of Lawrence Rappaport, is substituted for the deceased defendant Lawrence Rappaport, and the caption has been amended accordingly; and it is further,
ORDERED that the respondents' time to serve and file their briefs is enlarged until November 10, 2008, and the respondents' respective briefs shall be served and filed on or before that date; and it is further,
ORDERED that the appellants' reply brief, if any, shall be served and filed in accordance with the rules of this court.
