It is Ordered that the motion insofar as it seeks to vacate the dismissal of the appeal for failure to timely serve and file a Notice of Appeal is denied. The appellant has failed to establish that the Notice of Appeal was timely served or filed. [see CPLR § 5513] The motion insofar as it seeks various other relief is denied.
