Motion by the appellant, inter alia, to stay all discovery in the above-entitled action as well as a hearing on the respondent's counterclaims, pending hearing and determination of appeals from an order of the Supreme Court, Nassau County, dated May 6, 2008, and an order of the same court entered October 16, 2008, and for a preference in the calendaring of the appeals.
Upon the papers filed in support of the motion, the stipulation of the parties dated October 29, 2008, and the papers filed in opposition to certain portions of the motion, it is
ORDERED that the motion is denied.
