| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from an order of the Supreme Court, Queens County, dated April 1, 2008, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the record on appeal. Cross motion by the respondent to strike pages 244 through 369 of the record on appeal on the ground that they contain matter dehors the record.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the cross motion is granted, and on or before December 3, 2008, the appellant shall delete or remove pages 244 through 369 from the copies of the record on appeal filed with the Clerk of the court; and it is further,
ORDERED that the motion is granted on condition that on or before December 3, 2008, the appellant deletes or removes pages 244 through 369 from the copies of the record on appeal filed with the Clerk of the court.
