| DECISION & ORDER ON MOTION |
Motion by the petitioners in a proceeding pursuant to CPLR article 78 to review a determination of the New York State Department of State, dated September 5, 2008, which was transferred to this court by order of the Supreme Court, Queens County, dated October 22, 2008, in effect, to stay enforcement of the determination pending hearing and determination of the proceeding.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and enforcement of the determination is stayed pending hearing and determination of the proceeding on condition that the proceeding is perfected on or before December 15, 2008; and it is further,
ORDERED that in the event that the proceeding is not perfected on or before December 15, 2008, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay, on three days notice.
