| DECISION & ORDER ON MOTION |
Motion by the appellant Lucille Roberts Health Clubs, Inc., to stay the trial in the above-entitled action pending hearing and determination of appeals from an order of the Supreme Court, Kings County, dated September 29, 2008.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the trial in the above-entitled action is stayed pending hearing and determination of the appeals; and it is further,
ORDERED that on or before December 17, 2008, the appellant Global Flooring Group shall serve and file its brief and a supplemental joint record containing its notice of appeal; and it is further,
ORDERED that on or before January 21, 2009, the respondents shall serve and file their brief, if any.
