| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Family Court, Queens County, dated March 11, 2008, on the ground that the appellant failed to provide a complete transcript of the proceedings. Cross motion by the appellant to deem the "record on appeal sufficient" or to enlarge the time to provide the missing transcripts.
Upon the papers filed in support of the motion and the cross motion, the papers filed in opposition to the motion, and no papers having been filed in opposition or in relation to the cross motion, it is
ORDERED that the motion is denied on condition that on or before January 20, 2009, the appellant file the missing transcripts with the Clerk of this court; and it is further,
ORDERED that the branch of the cross motion which is to enlarge the time to provide the missing transcripts is granted to the extent set forth above; and it is further,
ORDERED that the cross motion is otherwise denied.
