| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Family Court, Suffolk County, dated October 17, 2008, in effect, to amend a decision and order on motion of this court dated October 31, 2008, as conditioned a stay of enforcement of so much of the order as directed his placement in a limited secure facility until April 7, 2010, and released him to the care and custody of his father, Notan D., pending hearing and determination of the appeal, inter alia, upon the perfection of the appeal on or before December 1, 2008.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that is granted; and it is further,
ORDERED that the decision and order on motion dated October 31, 2008, is amended by deleting from the decretal paragraphs thereof the date "December 1, 2008," and substituting therefor the date "January 5, 2009".
