It is Ordered that the motion is granted only to the extent of continuing the stay of the re-letting of the premises until after December 9, 2008. If, by said date, the appeal has been perfected and the September, October and the December use and occupancy has been tendered to the petitioner, without prejudice, then the appellant may move for a further continuation of the stay. Otherwise, the apartment may be re-let after December 9, 2008.
