On the court's own motion, it is
ORDERED that its decision and order on motion dated November 20, 2008, in the above-entitled case, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Nassau County, dated May 6, 2008, is amended by deleting from the second paragraph thereof the words "no papers having been filed", and substituting therefor the words "the papers filed".
