Motion by the defendants for leave to appeal to the Court of Appeals from a decision and order on motion of this court dated August 28, 2008, which determined their motion, inter alia, for leave to appeal to this court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated September 27, 2007, which affirmed a judgment of the Justice Court, Town of Southampton, Suffolk County, dated August 11, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
