| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Family Court, Kings County, dated March 11, 2008, to amend a decision and order on motion of this court dated July 22, 2008, which granted his motion to enlarge the judgment roll.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the decision and order on motion of this court dated July 22, 2008, is amended by deleting therefrom "Indictment No. 8425/06," and substituting therefor "Indictment No. 8426/06," so that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings in the action entitled People v Edwin A., commenced in the Supreme Court, Kings County, under Indictment No. 8426/06, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9) within 45 days of the date of this decision and order on motion; in the case of stenographers, both transcripts shall be filed with the clerk of the Court in which those matters were commenced, and the clerk shall furnish one of such certified transcripts to the appellant's counsel, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Court in which those matters were commenced and one transcript shall be delivered to the appellant's counsel. The appellant's counsel is directed to provide copies of said transcripts to all of the other parties to the appeal if any, when counsel serves the appellant's brief upon those parties; and it is further,
ORDERED that in the event the stenographer has already prepared a copy of any of the minutes, then the Clerk of the trial court is directed to reproduce a copy thereof for the appellant's counsel; and it is further,
ORDERED that the appellant's counsel is directed to serve a copy of this decision and order on motion upon the Clerk of the Supreme Court, Kings County.
