Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated May 28, 2008, pursuant to CPLR 5520(a) to extend the time to serve a notice of appeal, which was timely filed.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the notice of appeal, which was timely filed, is deemed timely served pursuant to CPLR 5520(a) on the attorneys representing the plaintiff Feliks Stolberg on the counterclaim against him.
