On the court's own motion, it is
ORDERED that its decision and order on motion dated November 18, 2008, in the above-entitled matter, which denied a motion by the appellant and a cross motion by the respondent on an appeal from an order of the Surrogate's Court, Nassau County, dated September 30, 2008, is amended by deleting from the first paragraph thereof the word "Kings," and substituting therefor the word "Nassau".
