On the court's own motion, it is
ORDERED that its decision and order on motion dated November 24, 2008, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the appellant's assigned counsel to be relieved of the assignment to prosecute an appeal from an order of the Supreme Court, Kings County (IDV part), dated May 20, 2008. The motion for assignment of counsel was granted on September 29, 2008, and the following named attorney was assigned as counsel to prosecute the appeal:

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that pursuant to Family Court Act § § 262 and1120 and Judiciary Law § 35, the following named attorney is assigned as counsel to prosecute the appeal:
