Korelis, Constanine v Elite Mgt.
It is Ordered that the motion for indeterminable relief is denied, without prejudice to renew upon proper service and papers. The Court notes that the proper method to challenge a decision of the trial court is to proceed with an appeal rather than through motion practice. Service of papers must be made a person not a party to the proceeding. ( see CPLR § 2103[a] )
