An order having been entered on November 13, 2007, assigning Kathleen P. Reardon, Esq. as counsel to perfect the appeal, and an order having been entered October 3, 2008, relieving counsel of her assignment,

Now upon the Court's own motion,

It is hereby ORDERED that James S. Hinman, Esq., 16 East Main Street, Suite 260, Rochester, New York 14614, is substituted as counsel to conduct the above-entitled appeal taken from an order of the Jefferson County Court entered March 22, 2007, in place of Kathleen P. Reardon, Esq.; and said appeal may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (1) and ten copies of appellant's brief reproduced pursuant to CPLR 5529; and

It is further ORDERED that the Clerk of Jefferson County is directed to provide James S. Hinman, Esq. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based; and

It is further ORDERED that the order of this Court entered March 3, 2008 is hereby amended by striking therefrom the date May 2, 2008 and inserting in place thereof the date February 20, 2009.
