| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on application dated October 6, 2008, in the above-entitled matter, which denied an application by the defendant for a writ of error coram nobis to vacate a judgment of the Supreme Court, Kings County, rendered April 27, 1987, in effect, on the ground that trial counsel was ineffective for failing to file a notice of appeal or to extend his time to file a notice of appeal, is amended by deleting from the first paragraph the words "Queens County," and substituting therefor the words "Kings County".
SANTUCCI, J.P., DILLON, DICKERSON and CHAMBERS, JJ., concur.
