ORDERED that its decision and order on motion dated November 21, 2008, in the above-entitled case, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Queens County, rendered September 3, 2008, is amended by deleting from the caption thereof the following information "Ind. No. 2999/07", and substituting therefor the following information "Ind. No. 2999/04".
