It is Ordered that the motion for a stay is granted on condition that the appellant continues to pay for accruing use and occupancy on each subsequent rental due date, without prejudice. The December 2008 use and occupancy must be tendered to the petitioner by no later than December 12, 2008.In the event of appellant's failure to comply with the orders of this Court, the petitioner may move on five days' notice for an order vacating the stay.
