DECISION

Motion by appellant to file opposition to respondent's motion to dismiss the appeal is denied.

By an order of this court dated August 12, 2008, appellant's notice of appeal from the order dated May 30, 2008 was deemed to be a valid notice of appeal rendering the instant motion moot.

It is noted that appellant has failed to submit a sworn affidavit in support of the motion.
