Motion by the defendant for an extension of time to move for leave to appeal from an order of the Supreme Court, Kings County, dated August 13, 2008, issued pursuant to CPL 440.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and the defendant's time to move for leave to appeal from the order dated August 13, 2008, issued pursuant to CPL 440, is extended until February 9, 2009.
