DECISION & ORDER ON MOTION

Motion by the respondent to dismiss as abandoned an appeal from a judgment of the County Court, Nassau County, rendered January 19, 2007.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied with leave to renew unless on or before January 23, 2009, the appellant perfects the appeal, or notifies the court that he has retained new counsel, or moves for leave to prosecute the appeal as a poor person and for the assignment of counsel.
