Now, upon reading and filing the affidavit of Tracey A. Brunecz, sworn to October 31, 2008, the notice of motion with proof of service thereof, the affidavit of Lyle T. Hajdu, sworn to November 3, 2008, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the appeal is removed from the calendar for the term of this Court commencing on February 23, 2009, and

It is further ORDERED that the appeal be added to the calendar for the term of this Court commencing on May 11, 2009, and

It is further ORDERED that the time to file and serve a respondent's brief is extended to April 6, 2009, and

It is further ORDERED that the time to file and serve a reply brief be and the same hereby is extended to April 21, 2009.
