| DECISION & ORDER ON MOTION |
Motion by the appellant to stay all proceedings in the above-entitled action pending hearing and determination of an appeal from an order of the Supreme Court, Nassau County, entered April 22, 2008. Application by the respondent to adjourn the return date of the motion and pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branch of the application which is to adjourn the return date of the motion is denied; and it is further,
ORDERED that the branch of the application which is pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief is granted and the respondent's time to serve and file a brief is enlarged until January 15, 2009, and the respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the motion is denied.
