DECISION
On the court's own motion, the matter is stricken from the general calendar, all briefs shall be returned to the respective parties and the record remitted to the court below. The stay contained in the order of this court dated May 29, 2008 is continued on condition that appellant perfects the appeal, including settling any and all minutes pursuant to CCA 1704, by February 6, 2009. Appellant shall continue to comply with all the conditions contained in the order of this court dated May 29, 2008.
