Motion by the appellant, inter alia, to direct the Supreme Court, Westchester County, to comply with a decision and order of this court dated April 15, 2008, which determined an appeal from an order of the Supreme Court, Westchester County, entered September 18, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied without prejudice to seeking the same relief after the plaintiff appeals from an order of the Supreme Court, Westchester County, dated December 1, 2008.
