DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of so much of an order of the Family Court, Suffolk County, dated November 17, 2008, as permits the respondent to have visitation with the subject child, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the respondent's visitation with the subject child shall be supervised, pending hearing and determination of the appeal, and the matter is remitted to the Family Court, Suffolk County, to determine who shall supervise visitation and to set a visitation schedule pending hearing determination of the appeal, and the motion is otherwise denied.
