| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Supreme Court, Kings County, dated October 23, 2007, (1) in effect, for leave to serve and file a supplemental record containing the memorandum of law of Kevin O'Donnell dated February 20, 2007, the memorandum of law of Gregory Antollino dated April 18, 2007, and the reply memorandum of law of Kevin O'Donnell dated June 19, 2007, and (2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before January 22, 2009, the respondent shall serve and file a supplemental record containing the memorandum of law of Kevin O'Donnell dated February 20, 2007, the memorandum of law of Gregory Antollino dated April 18, 2007, and the reply memorandum of law of Kevin O'Donnell dated June 19, 2007; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until January 22, 2009, and the respondent's brief must be served and filed on or before that date.
