| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated December 5, 2008, in the above-entitled matter, which held in abeyance a motion by the attorney for the appellant, on an appeal from an order of the Family Court, Kings County, dated September 16, 2008, is amended by
(1) deleting from the first decretal paragraph the words "December 29, 2009," and substituting therefor the words "January 20, 2009,"
(2) by adding to the last decretal paragraph thereof after the words "in the interim" the following: "and it is further," and
(3) by adding thereto after the last decretal paragraph the following decretal paragraph:
"ORDERED that counsel shall serve a copy of this decision and order upon the appellant on or before January 6, 2009, by one of the methods specified in CPLR 2103(c) and shall file proof of such service with this court."
