It is Ordered that the motion is granted to the extent of permitting the warrant of eviction to be executed after January 30, 2009. This is to afford the appellant a final opportunity to perfect the appeal. If, by said date, the appeal has been perfected and the appellant is current in the payment of accruing use and occupancy, then the appellant may move for a continuation of the stay.
