ORDERED that the order on application of this court dated December 5, 2008, in the above-entitled appeal is recalled and vacated and the following order on application is substituted therefor:
Application by the defendants-respondents Robert Silverman and Deborah Laitman Silverman pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, dated July 17, 2008.
ORDERED that the application is granted and the movants' time to serve and file a brief is enlarged until January 5, 2009, and the movants' brief must be served and filed on or before that date.
