ORDERED that the motion for an extension of time to perfect the appeal is granted, without costs, and the time to perfect the appeal is extended to February 13, 2009, and it is further

ORDERED that the motion for a stay pending appeal is granted, without costs, on the condition that plaintiff's counsel shall continue to hold the sum of $330,000 in escrow pending determination of the appeal.
