It is Ordered that the motion is granted to the extent of staying the re-renting of the apartment on condition that the September and October use and occupancy is tendered to the petitioner, along with the January 2009 payment due, by January 9, 2009. Accruing use and occupancy is to be tendered to the petitioner pending the determination of the appeal. In the event of appellant's failure to comply with the orders of this Court, the petitioner may move on five days' notice for an order vacating the stay.
