DECISION & ORDER ON MOTION

Application for a writ of habeas corpus, and motion by the petitioner for poor person relief. By decision and order on motion dated March 31, 2008, as amended October 31, 2008, the petitioner's motion for poor person relief was denied and the petitioner was given until December 1, 2008, to pay the filing fee or the proceeding would be dismissed. The filing fee has not been paid.

Now, on the court's own motion, it is

ORDERED that the proceeding is dismissed, without costs or disbursements.
