It is Ordered that the motion and cross-motion are consolidated for disposition. The stay is continued, to and including February 9, 2009. This is to afford the appellants a final opportunity to perfect the appeal. If, by said date the appeal has been perfected and the appellants are current in the payment of accruing use and occupancy, then the appellants must move for a further continuation of the stay . Otherwise, the warrant of eviction may be enforced after February 9, 2009.
