It is Ordered that the motion is granted to the extent of staying the traverse in this action pending the determination of the appeal provided it is perfected by no later than the April 2009 term - the filing deadline is February 10, 2009. If the appeal is not perfected by said date, the stay is automatically vacated and the traverse is restored to the trial court calendar.
