| DECISION & ORDER ON MOTION |
Separate appeals by Jessie S. C. and Herby C. from an order of the Family Court, Kings County, dated March 19, 2008. By decision and order on motion of this court dated September 9, 2008, that branch of the motion of the appellant Jessie S. C. which was for leave to prosecute the above-entitled appeal as a poor person was denied with leave to renew on or before September 30, 2008. The motion has not been renewed. By scheduling order of this court dated October 23, 2008, the appellant Jessie S. C. was directed to file an affidavit or affirmation in the office of the Clerk of this court, within 15 days after the date of the scheduling order. The appellant Jessie S. C. has failed to comply with the scheduling order. On the court's own motion it is
ORDERED that the appeal of Jessie S. C. is dismissed, without costs or disbursements.
