On the court's own motion, it is
ORDERED that its decision and order on motion dated November 7, 2008, in the above-entitled matter, which granted, in part, a motion by the petitioner in a proceeding pursuant to CPLR article 78, which was transferred to this court by an order of the Supreme Court, Dutchess County, entered February 4, 2008, is amended by deleting from last paragraph the date "January 5, 2008," and substituting therefor the date "January 5, 2009."
