DECISION & ORDER ON MOTION

Motion by the appellant to stay the respondents from taking any action to reduce or affect the appellant's ownership interest in the respondent Daily Mirror Associates and from requiring the appellant to make any capital contributions based on the parties stipulations on August 14, 2008, and September 24, 2008, pending hearing and determination of an appeal from an order of the Supreme Court, Kings County, entered December 12, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the respondents are stayed from taking any action to reduce or affect the appellant's ownership interest in the respondent Daily Mirror Associates and from requiring the appellant to make any capital contributions based on the parties' stipulations on August 14, 2008, and September 24, 2008, pending hearing and determination of the appeal on condition that the appeal is perfected on or before February 13, 2009; and it is further,

ORDERED that in the event the appeal is not perfected on or before February 13, 2009, the court, on its own motion, may vacate the stay, or the respondents may move to vacate the stay, on three days notice.
