DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the Supreme Court, Queens County, dated May 6, 2008, (1) to enlarge the record to include the appellant's papers submitted in support of her motion, inter alia, to reargue and renew, the respondent's opposition papers, the appellant's reply papers, the transcripts of the proceedings on August 13, 2008, concerning the appellant's motion, and the affidavit of mailing of the verified cross petition, with proofs of mailing and case history of the court file documenting filing of the amended cross petition, and (2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that on or before February 13, 2009, the respondent shall serve and file a supplemental record containing the appellant's papers submitted in support of her motion, inter alia, to reargue and renew, the respondent's opposition papers, the appellant's reply papers, the transcripts of the proceedings on August 13, 2008, concerning the appellant's motion, the affidavit of mailing of the verified cross petition, with proofs of mailing and case history of the court file documenting filing of the amended cross petition, and the order determining the appellant's motion; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until February 13, 2009, and the respondent's brief must be served and filed on or before that date.
