Now, upon reading and filing the affirmation of Susan Gray Jones, Esq., dated November 24, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal is dismissed as unnecessary, and
It is further ORDERED that the motion insofar as it seeks an order relieving appellant's counsel of her assignment is granted and the appeal is dismissed as abandoned.
