THE PEOPLE OF THE STATE OF NEW YORK,

-against-

CHRISTOPHER R. EBEL,

Appellant.

DECISION

Motion by the appellant for poor person relief is denied without prejudice to renewal upon furnishing this court with proper papers.

On the court's own motion, an enlargement of time to perfect the appeal is granted, and appeal shall be perfected by April 3, 2009.

Defendant has failed to furnish this court with all the financial information necessary to determine whether he is indigent, specifically defendant has not explained with what funds he retained counsel in the court below and from where he derives his monthly income of approximately $300. Defendant has also failed to complete question 6E in the application for poor person relief, which asks whether he has any other investments.
