Appeals having been taken herein from orders of the Family Court, Genesee County, entered in the Office of the Clerk of said Court on December 17, 2007
(Appeal Nos. 1 and 2), and October 2, 2008 (Appeal No. 3), and respondent-appellant having moved to vacate the dismissal of Appeal Nos. 1 and 2, to consolidate all appeals, and for an order directing petitioner-respondent to restore respondent-appellant's visitation with the subject child pending the determination of the appeals,
Now, upon reading and filing the affidavit of Sean K., sworn to December 3, 2008, the affirmation of Michael Steinberg, Esq., dated December 10, 2008, the notice of motion with proof of service thereof, the affidavit of Jacqueline M. Grasso, Esq., sworn to December 22, 2008, the affirmation of Colleen Sutherland Head, dated December 22, 2008, the affirmation of Michael Steinberg, Esq., dated December 24, 2008, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of Appeal Nos. 1 and 2 is granted, and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals is granted, and
It is further ORDERED that respondent-appellant file the original stipulated or settled record and ten briefs on the consolidated appeals, together with proof of service, on or before March 16, 2009, and in the event of failure to so perfect the appeals are hereby dismissed without further order, and
It is further ORDERED that the motion insofar as it seeks an order restoring visitation during the pendency of the appeals is denied.
