On the court's own motion, it is
ORDERED that its decision and order on motion dated January 13, 2009, in the above-entitled matter, which granted a motion by the appellant, on an appeal from an order of the Supreme Court, Nassau County, dated January 2, 2008, is amended by deleting from the second paragraph the words "no papers having been filed in opposition or in relation thereto," and substituting therefor the words "the papers filed in opposition thereto."
